1. Scope
This policy covers the data of visitors to the hamiltonapps.com website, as well as that of prospects and contacts who write to us.
Data that our customers process in our software (Hamilton Visitor, Hamilton Meeting, Hamilton Security and our other applications) is not covered by this policy. For that data, Hamilton Apps acts on behalf of its customers, under our GDPR Provisions (in French).

3. Data collected and purposes
Demo requests, free trial and contact
When you fill in a form on the website, we collect your surname, first name, business email address, phone number, company name, job title and, where applicable, your message.
This data is used to respond to your request, arrange a demo, give you access to the free trial and carry out sales follow-up.
Legal basis: pre-contractual measures taken at your request and, for sales follow-up, our legitimate interest in developing our business with professionals.
Downloading white papers and guides
To download a white paper or guide, we ask you for the same business information. It is used to send you the document and to offer you content related to your interests.
Legal basis: our legitimate interest. You can object at any time to the emails that follow the download.
Newsletters and information emails
We send newsletters and information emails about our solutions via the Sarbacane platform. These emails are aimed at professionals and cover topics related to their role.
Legal basis: our legitimate interest, in line with the rules that apply to business-to-business marketing. Every email contains an unsubscribe link.
Customer support
When you contact us through the website chat, your conversations are handled via the Intercom tool. We keep your name, email address and the content of the conversation to respond to your request and follow up on its resolution.
Legal basis: the performance of the contract between us and our customers and, for visitors, our legitimate interest in answering their questions.
Audience measurement and advertising
With your consent, we use cookies to measure website traffic and the effectiveness of our advertising campaigns (see section 7).
Legal basis: your consent, collected via the cookie banner.
Website security
To protect the website against attacks, our infrastructure technically processes your IP address and connection data.
Legal basis: our legitimate interest in keeping the website secure.
We do not collect any special category data within the meaning of the GDPR, nor any payment data, through this website. No automated decision producing legal effects concerning you is made on the basis of your data.
4. Recipients of the data
Your data is intended for the Hamilton Apps sales, marketing and support teams, each within its own remit.
It may be shared with service providers that help us run the website and our services, and that act on our instructions:
OVHcloud, for hosting the website, within the European Union;
Cloudflare, for protecting the website against attacks;
Sarbacane, for sending emails and newsletters;
Intercom, for chat and customer support;
Axeptio, for managing your cookie consent;
Google (Google Analytics, Google Tag Manager, Google Ads), for audience measurement and advertising;
LinkedIn, for measuring and running our advertising campaigns.
We never sell your personal data.
5. Transfers outside the European Union
Some of our service providers, including Google, LinkedIn, Intercom and Cloudflare, may process data in the United States. These transfers are covered by the European Commission's adequacy decision on the Data Privacy Framework, for certified companies, or failing that by the standard contractual clauses adopted by the European Commission.
6. Retention periods
Prospects (demo requests, contacts, downloads, newsletter subscribers): 3 years from your last contact with us.
Customers: for the whole term of the contractual relationship, then for the statutory limitation periods.
Support conversations: 3 years from the last exchange.
Audience measurement and advertising cookies: 13 months maximum. The related statistical data is kept for 25 months maximum.
Your cookie choice: 6 months, after which we ask you again.
Technical logs: the logs of our infrastructure, hosted by OVHcloud, are kept for one year, in line with our Security Assurance Plan (in French). Cloudflare technical logs are kept for the periods set by that provider to protect the website.
At the end of these periods, the data is deleted or anonymised.
7. Cookies
A cookie is a small file placed on your device when you visit a website. On your first visit, a banner managed by Axeptio lets you accept or reject cookies, either all at once or by category. Rejecting is as easy as accepting, and rejecting does not prevent you from using the website.
You can change your choices at any time by clicking the “Cookie settings” link at the bottom of every page.
Strictly necessary cookies
These allow the website to work and remember your cookie choice (Axeptio). They do not require your consent.
Audience measurement cookies
Google Analytics, deployed via Google Tag Manager, tells us which pages are viewed and how visitors reach the website, so that we can improve it. These cookies are only set with your consent.
Advertising cookies
Google Ads and LinkedIn Ads (LinkedIn Insight Tag) measure the effectiveness of our campaigns and allow us to show our content to professionals who may be interested. These cookies are only set with your consent.
Email tracking
Emails sent via Sarbacane contain elements that tell us whether an email has been opened and whether a link has been clicked. This information is used to measure interest in our emails and to target them better.
Social networks
The website contains links to our LinkedIn, X (Twitter) and Instagram pages. When you click these links, you leave our website: the processing of your data is then governed by each social network's privacy policy.
8. Your rights
Under the GDPR and the French Data Protection Act (loi Informatique et Libertés), every Data Subject has the following rights over their data:
the right of access;
the right to rectification;
the right to erasure;
the right to restriction of processing;
the right to object, in particular to direct marketing, which you can exercise at any time without giving a reason;
the right to data portability;
the right to withdraw your consent at any time, where processing is based on it;
the right to set instructions for what happens to your data after your death.
To exercise these rights, email [email protected] or write to Hamilton Apps, Data Protection Officer, 55 rue de Turbigo, 75003 Paris, France. We will reply within one month. We may ask you for proof of identity if we have reasonable doubts about your identity.
If, after contacting us, you believe that your rights have not been respected, you can lodge a complaint with the CNIL, the French data protection authority: www.cnil.fr
9. Security
We implement appropriate technical and organisational measures to protect your data against loss, unauthorised access or disclosure: hosting within the European Union, protection of the infrastructure against attacks, encrypted connections (HTTPS), and access to data restricted to those who need it, on the principle of least privilege. These measures are detailed in our Security Policy (in French).
10. Changes to this policy
We may update this policy, in particular to reflect new legal obligations or new tools. The date of the last update is shown at the top of the page.
